CGF Publishes New Carry License Application Guides/FAQs, Compliance Initiative Lawsuits Update

Here we are in January of 2012 (where did last year go?), and things are quite wonderfully picking up right where we left off at the end of 2011. In the spirit of resolutions and looking forward to what the future holds for the ability to exercise your fundamental right to carry firearms for self-defense, we thought some carry license guides and information, as well as an update on Carry License Sunshine & Compliance Initiative actions, would be of particular interest to you.


Thanks to our good friends Ed Worley and Tom Pederson of NRA and CRPA, respectively, California Senate Bill 610 necessarily created a bit of very positive work for us in revising our Model Policy and Common Misconceptions documents to reflect the Legislature’s commitment to a uniform system of carry license application.

Well, you know us: why simply make things better when we can do all that and help more Californians lawfully carry handguns for self-defense by adding new resources to the mix? Without further adieu, I’ll respectfully direct your attention to the below list of new and updated documents now available for download in the Carry License Documents & Records section at www.calgunsfoundation.org/downloads. Contained within these handy application assets are answers to dozens of the most commonly-asked questions we’ve seen. For example:

* How did SB 610 change the application process?
* What can I expect from the post-SB 610 application process?
* Can a licensing authority “screen” prospective applicants or require an applicant to "pre-apply" before submitting an application?
* Can a licensing authority require you to be a resident of their city/county for a specific period of time before applying?
* Can a licensing authority require you to provide proof of ownership and/or registration of firearms listed on an application or amendment form?

Revised for the 2012 law updates is our Model License to Carry Policy, which we hope you’ll suggest to your local licensing authority. As they say, all politics is local; you really can make a difference by providing your licensing authority with a turnkey solution – like our Model Policy – and copies of the various Guides to help them understand their responsibilities under the law (indeed, that these issues matter to all of us).

On the Compliance front of the Initiative, you may be aware that we filed Rossow v. Sheriff Mark Pazin and Merced County last July to challenge a great number of policies and practices that we believe to be unlawful. [So many, in fact, that an entire 5-page exhibit (D) to the complaint was dedicated to listing them out.] That case will very soon proceed to discovery and continue on to trial.

In October, we filed Early v. San Mateo County, an important state pre-emption action seeking to ensure that anyone who can lawfully carry a firearm for self-defense may do so at local parks and similar properties. That case currently has a hearing set for April 24, 2012.

What’s next, then, you ask.

Certainly, a new lawsuit seeking to force licensing authorities to perform their statutory duties and accept all carry license applications from residents of their jurisdiction; the unlawful hoop-jumping to even begin the process, such as a requirement to first apply to and be denied by another licensing authority before submitting an application, must end now.


Other issues that are on the strategic litigation radar include – but are not limited to – unlawful requirements for additional forms that serve only to burden the application process, adversarial interrogations and testing, time-in-residency requirements, and medical evaluations that go beyond those allowed under the statues. Stay tuned; 2012 should be a very busy year for the Initiative’s litigation and compliance efforts.

Cold, hard fact: all of the above takes not just hard work, but fiscal dedication as well. If you want to see more and more lawsuits like these, please help us by sharing this message with your family and friends. Be vocal about how these efforts are game-changers, and urge them to support our numerous battles for Second Amendment rights by making a tax-deductible donation or sponsoring a county today.
