Gun owners in California and across the nation have a huge opportunity coming up -- and we need your support to take full advantage of it.
United States Supreme Court Justice Anthony M. Kennedy recently set September 1 as the filing deadline to submit a petition for a writ of certiorari for Silvester, et al. v. California Attorney General Becerra, our Second Amendment civil rights lawsuit challenging the State of California’s firearm waiting period laws (i.e. the ‘10-day waiting period’).
Remember that, after significant discovery, holding depositions, and a full 3-day trial complete with live testimony from parties and experts from both sides, federal District Court Judge W. Anthony Ishii found that the waiting period laws unconstitutionally and irrationally burden Second Amendment rights of most California gun owners. This was a huge and important victory for gun rights.
But the 9th Circuit ignored this extensive record, ignored the evidence, ignored the standard of review after a trial, and ignored the good and proper judgment of Judge Ishii when they decided that the waiting period laws were just fine.
And 9th Circuit Chief Judge Sydney Thomas even wrote separately to say that, since the law was merely a ‘condition’ or ‘qualification’ on the purchase of a firearm, the State’s waiting period laws (and just about anything like them) were perfectly constitutional based on his misreading of District of Columbia v. Heller.
This is a travesty that we need the United States Supreme Court to fix. And this case presents the perfect opportunity for the Court to weigh back in on the Second Amendment and tell the 9th Circuit to stop playing fast and loose with your constitutional rights.
But to get this critical cert petition filed and prepare for taking this case all the way at the Supreme Court, we need to raise $50,000 by September 1.
